Qualifying criteria
Do I qualify for the Right to Manage?
Eligibility depends on several tests set out in legislation. Below is a plain-English summary of the themes we ask about in our quiz — not a substitute for checking your own leases and building details.
Building type
Usually at least two self-contained flats in a structurally separate building with its own boundary and entrance.
Long leases
A high proportion of flats must be held on leases originally granted for more than 21 years (the law sets exact thresholds).
Participation
Enough qualifying leaseholders must be willing to be members of the RTM company — the required proportion depends on how many flats there are.
Commercial space
If more than a set share of floor space is non-residential, the building may not qualify.
Conversions and resident landlords
Some converted houses and buildings where the landlord lives on site are treated differently; special rules apply.
